1. Acceptance of Terms
By accessing or using NavSphere (the “Service”), including the mobile application, website, APIs, and related services, you agree to be bound by these Terms of Service (“Terms”).
If you do not agree to these Terms, you must not access or use the Service.
NavSphere is an informational and community-based aviation platform.
2. Eligibility
You may use the Service only if:
You are at least 13 years of age
You are legally able to form a binding contract
You are not prohibited from using the Service under applicable laws
If you are between 13 and 16 years of age, you must have the consent of a parent or legal guardian.
3. Account Registration and Security
Certain features of the Service require account registration.
You agree to:
Provide accurate, current, and complete information
Maintain the confidentiality and security of your account credentials
Accept responsibility for all activities that occur under your account
NavSphere reserves the right to suspend or terminate accounts that violate these Terms.
4. User Content
NavSphere allows users to create and share content, including posts, images, map pins, comments, and reactions (“User Content”).
4.1 Ownership
You retain ownership of your User Content.
4.2 License to NavSphere
By submitting or posting User Content, you grant NavSphere a non-exclusive, royalty-free, worldwide license to host, store, display, reproduce, and distribute such content solely within the Service.
This license terminates when you delete your User Content, except where retention is required for backup, legal, compliance, or operational purposes.
4.3 Responsibility
You are solely responsible for the User Content you post.
You agree not to post content that is unlawful, misleading, harmful, abusive, defamatory, obscene, or that infringes upon the rights of others.
5. Content Moderation
NavSphere reserves the right to:
Remove or restrict access to User Content at its discretion
Suspend or terminate accounts that violate these Terms
Cooperate with lawful requests from government or regulatory authorities
NavSphere does not guarantee that User Content will be reviewed prior to publication.
6. Maps and Aviation Disclaimer
Maps, location-based features, and visual tools within NavSphere are not intended for navigation or operational use.
NavSphere:
Does not provide flight navigation services
Does not replace official aeronautical charts, NOTAMs, ATC instructions, or certified flight planning tools
Provides informational, visual, and community-generated content only
NavSphere does not provide professional aviation, safety, or operational advice.
All aviation-related decisions must be made using certified sources and professional judgment.
Use of map and location features is entirely at your own risk.
7. Subscriptions and Payments
Certain features of the Service may require a paid subscription.
Payments are processed exclusively through the Apple App Store
Charges are billed to your Apple ID
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
Subscription management and cancellation must be handled through your Apple ID settings
NavSphere does not process refunds directly
8. Intellectual Property
All content and materials within the Service, excluding User Content, including trademarks, logos, designs, software, and proprietary technology, are owned by NavSphere and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, or otherwise exploit any part of the Service without prior written permission from NavSphere.
9. Termination
You may stop using the Service at any time.
NavSphere may suspend or terminate your access to the Service if:
You violate these Terms
Required by law
The Service or a portion of it is discontinued
10. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
NavSphere makes no warranties, express or implied, regarding the accuracy, reliability, availability, or fitness of the Service for any particular purpose.
11. Limitation of Liability
To the maximum extent permitted by law, NavSphere shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
